Step 1. RESERVE
To reserve a condo or villa, pls fill in the following reservation document, sign it and send it back to the name and address in the attachment. The Developer will sign it and send buyer a copy for their records. Buyer will have Ten (10) working days to make a refundable deposit to Stewart Title & Trust CR, of Ten Thousand US Dollars ($10 000) which will be held in a escrow sub-account under the name of the purchaser (directions are in the reservation form). The deposit will be refundable (less bank charges and escrow fees) should buyer decide not to go ahead with the purchase. Alternatively buyer will have ten (10) business days to confirm the purchase once he has been informed that construction is about to begin.
2. PURCHASE AND SALES AGREEMENT
Within ten (10) business days of being informed, a Purchase and Sales Agreement (PSA) will need to be signed by both parties. At this point, the reservation deposit becomes non refundable, and is automatically rolled into buyers first down payment.
Payment terms are as follows:
1. Thirty three percent (33%) of the purchase price (less $10 000) deposited upon signing of the Purchase and Sales Agreement.
2. Thirty three percent (33%) of the purchase price upon installation of the final floor slab of the building in which the unit is located.
3. Thirty four percent (34%) of the purchase price upon installation of the finishing details in the building in which the unit is located.
4. Upon closing, the insurance policy will terminate
Closing costs, taxes and other fees.
All closing costs and taxes will be borne by the purchaser:
Land transfer taxes and registry stamps: 2.33% of purchase price
Notary fees: approximately 1.25% of purchase price
Yearly property taxes are 0.25% of the declared property value, payable on a quarterly or annual basis.
TITLE GUARANTY
In Costa Rica, lawyers act as a public notary, and in doing so are responsible for assuring that the property being transferred is free and clear of all encumbrances, encroachments and disputes. This verification is normally performed twice during the purchase cycle; once prior to signing the Purcahase and Sales agreement, and once prior to the closing. Montelaguna Residence is clear and free of any disputes, however, should Buyer wish to have a title company perform an additional check, this is possible at Buyers cost.
